International transfer of information
Wizards’ servers and customer support team reside in the United States. If you choose to provide us with Personally Information, such information may not only be shared with our parent company (its affiliates and subsidiaries) and third party service providers (as provided in this policy), it may also be transferred across borders, and from your country or jurisdiction to other countries or jurisdictions around the world.
If you reside in the European Union or in countries with laws governing data collection and use that differ from the United States, please note that by providing Wizards with your Personally Information, you are expressly consenting to the transfer of your Personally Information to the United States as well as other jurisdictions where Wizards conducts business or provides services.
What information does Wizards collect?
Non-Personal Information. Wizards uses tools and analytical software to automatically collect, store and use certain non-personal information affecting Magic Online that does not directly identify you. “Non-Personal Information” may include, but is not limited to, the following: (a) device properties including your IP address, unique device identifier or other persistent or non-persistent device identifier; (b) device software platform and firmware; (c) geographical data such as zip code, area code and location; (d) play data such as session data, browser identifiers, bug issues, bandwidth speed, as well as online usage metrics, statistics, analytics, game progress, time playing; and (e) other non-personal data as reasonably required by Wizards to enhance Magic Online and other Wizards’ games and services.
Personal Information. Wizards only collects Personal Information from you on a voluntary basis which may include your age, full name, email, shipping address, your DCI number, tax identification information, billing address, citizenship, and telephone number (“Personal Information”).
Financial Information. Wizards may also collect financial information from you such as credit card information (“Financial Information”).
When does Wizards collect my information?
Wizards automatically collects Non-Personal Information whenever you play Magic Online or connect to the Magic Online client or game servers. When you create a Magic Online user account (an “Account”) you will be required to provide a user name and a password and Personal Information such as your full name, email address and shipping and billing address. You will also be asked to provide Financial Information to facilitate your initial account transaction. For age verification purposes, we also ask for your birthday during the Account creation process.
We may also collect Personal and Financial Information from you when you:
- provide payment information*
- participate in the physical redemption promotion
- post in online forums, blogs and social media
- use Magic Online’s chat features
- shop at one of our affiliate online stores
- update your Account
- participate in tournaments and organized play events
- participate in contests, events, promotions or surveys
- contact customer support
*While Wizards may collect credit card data from its customers from time to time, it will also use third party credit card processing companies to process your payment transactions. When using such a third party processing company, Wizards will not have access to your credit card data.
Whatever the activity may be, we will only collect information to the extent it is reasonably necessary to fulfill your requests and our legitimate business objectives. If you do not want to submit Personal Information when requested, you will not be able to create an Account or access Magic Online.
Who is collecting my information and how will it be used?
We, or our third party partners and service providers, collect information you provide when you interact with us. We may use the information you submit to us to send you advertising or promotional materials including information about new products, contests, features and enhancements, special offers and other events of interest. We may also use your information for our internal research and demographic studies, so we can constantly improve our products and services. The demographic information (e.g., age and gender) you provide us is collected by Wizards and may be disclosed in aggregate to third parties. This aggregate demographic information cannot be used to personally identify you or your computer.
Third parties who fulfill services such as hosting, the physical redemption promotion, development, testing, or customer support may collect Personal Information from you. In addition to Personal Information, payment services such as Chase or PayPal may collect your Financial Information. These third parties will not use your Personal Information for any purpose other than to provide the related services, and have agreed to maintain confidentiality, surveys, security, and integrity of your Personal and Financial Information.
With whom does Wizards share my Personal Information?
Wizards may share your information with its related entities including its parent and sister companies. Wizards may also share Personal Information with third party service providers who assist us with operating Magic Online or provide us with various services (e.g. organized play, community operations, product fulfillment, email services, marketing and promotional services, or customer support). These entities will not use your Personal Information for any other purpose than that for which it was received by Wizards, and they agree to maintain the confidentiality, security, and integrity of all information (personal or otherwise) they receive from us.
We may disclose Personal Information in the good faith belief that we are required to do so by law including, but not limited to, disclosure to law enforcement or other government officials in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose you or us to legal liability.
Except as set forth herein, Wizards of the Coast LLC, as a subsidiary of Hasbro, Inc. does not sell or rent Personal Information collected from and about its customers to third parties. However, in the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, Wizards' customer information may be transferred to Wizards' successors or assigns.
If you engage in organized play, your full name, DCI number, city, state and email may be accessible by authorized tournament organizers, retail locations that are part of the Wizards Play Network, and members of the Wizards’ community that are adjudicating organized play events solely for the purpose of facilitating organized play. Your Personal Information may also be disclosed to members of the Wizards’ community who are engaged in investigating violations of tournament rules and the Code of Conduct (http://company.wizards.com/legal/code-conduct). Additionally, your full name, Magic Online user name, city and country (or portions thereof) may be displayed outside of the Magic Online game client and online services including, but not limited to, in Magic Online event coverage, leaderboards, promotional emails and video streaming.
Magic Online may also link to third-party social network services such as Facebook, Instagram, Reddit, and Twitter (or third-party social media plug-ins and applications). When you utilize social networks, you may allow us to have access to certain information from your social media profiles (e.g., name, email address, photo, gender, birthday, location, your list of friends, people you follow and/or who follow you, the posts or the ‘likes’ you make). We may also obtain non-personally identifiable information (e.g., content viewed, game performance, high scores, and information about advertisements within the content you have been shown or may have clicked on) from your interaction with our content.
Linking to third party Websites
To provide relevant information not found in the Magic Online client and to facilitate online shopping, Wizards may provide links to third party websites. We encourage our users to read third party websites' privacy policies before submitting Personal Information.
If you do not want Wizards to send you information about products, services or events, you may opt-out of receiving such communications at the time of registration. After registration, you may opt-out by going to Account > Policy Agreements and changing your mailing settings or by contacting customer support. Notwithstanding the foregoing, Wizards reserves the right to contact you with updates relating to your Account and terms and conditions and system announcements.
Safeguarding your Personal Information
Wizards only collects Personal Information to the extent deemed reasonably necessary to serve legitimate business purposes and to facilitate your requests. We take appropriate steps to ensure the security and integrity of any information you provide to us by using industry standard security processes and technology.
Review, update and removal of Personal Information
If you have registered an Account, you may at any time review or update the contact information we have for you or inform us that you want us to remove your information from our database by contacting customer support. Please be sure to include in your message the name of the feature for which you registered and the email address you used to register so that we can verify your request.
Your California Privacy Rights
Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Wizards who are California residents to request certain information regarding its disclosure of Personal information to third parties for their direct marketing purposes. We do not share our customer’s Personal Information with unaffiliated third parties for their own direct marketing purposes. Additionally, you may make a request to “be forgotten” from Magic Online. Upon such a request, with the exception of organized play statistics, we will remove all information regarding your account
A NOTE TO PARENTS
Magic Online is a general audience game and not intended for children under the age of 13. We understand and are committed to respecting the sensitive nature of children's privacy online and as such do not knowingly collect any Personal Information from anyone under the age of 13 in regards to Magic Online. If we learn or have reason to suspect that a player of Magic Online is under the age of 13, we will promptly delete that player’s Magic Online Account.
Teenagers (Ages 13-17)
Wizards may collect Personal Information from players over 13 and under 18 (each a "Teenager"). When a player in this age category submits Personal Information, Wizards may, but has not obligation, to request a parent or guardian's email address to notify the parent or guardian of the Teenager's activity.
